Conditions of Use

This agreement together with any additional terms, conditions, notices and disclaimers contained elsewhere on Oz Properties the conditions of supply of material on, use of and access to Oz Properties. Your continued use of Oz Properties constitutes an affirmative, acknowledgment and agreement by you that you accept and agree to abide and be bound by these conditions and any modifications.

Should you object to any of these conditions or any subsequent modifications your only recourse is to immediately discontinue your use of Oz Properties.

All terms and conditions that govern your use of Oz Properties (including disclaimers) may only be amended in writing signed by an authorized officer of Oz Properties and Oz Properties may amend them from time to time.

Accuracy of information and disclaimer of warranties

All material on Oz Properties is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of Oz Properties is at your sole risk. Access to Oz Properties is provided on an 'as available' basis. Neither Oz Properties its related bodies corporate nor its or their directors or employees make any representation or warranty that (i) any material on Oz Rentals will be reliable, accurate or complete (nor do they accept any responsibility arising in any way for errors in, or omissions from that material); or (ii) your access to Oz Rentals will be uninterrupted, timely or secure. Oz Properties will not be liable for loss resulting from any action or decision by you in reliance on the information on Oz Properties , nor any interruption, delay in operation or transmission, virus, communications failure, Internet access difficulties, or malfunction in equipment or software.

Copyright

The material provided on Oz Properties is copyright protected. You may use this material for your own personal reference only. Except for the temporary copy held in the computer's cache and a single permanent copy for your personal reference, the material may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act) without the prior written approval of Oz Properties or the appropriate supplier or licensor of Oz Properties.

You may not use any part of the material on Oz Properties site to establish, maintain or provide, or assist in establishing, maintaining or providing your own publications, Internet site or other means of distribution.

Your conduct

In consideration of your use of the Services, you will: (a) provide true, accurate, current and complete information about yourself and your business as prompted by the Services' registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Oz Properties has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Oz Properties has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

You will pay all subscription, service and use fees associated with the Services ("Fees") by authorized check, credit card or electronic fund transfer on or before the due date specified in any invoice we send you. Alternatively, you may authorize Oz Properties to charge your credit card or bank checking account for the amount of any Fees you owe. We reserve the right to change the Fees, in our sole discretion, upon notice to you, which notice may be given by posting any change in Fees in the Pricing Package area of the Oz Properties Web site (www.ozproperties.com.au) (the "Site"). Any change in Fees shall be effective thirty (30) days after we post the Change in Fees notice and shall affect Fees that are due in the calendar month that is immediately subsequent to the end of the thirty-day period. You will also pay all federal, state and local taxes, if any, levied now or in the future, that are applicable to your use or receipt of the Services. You will pay all costs (including, but not limited to, attorneys' fees), if any, we incur in collecting overdue fees from you.

Termination

You agree that Oz Properties, in its sole discretion, may terminate your password, your access to Oz Properties Subscription Services Site, use of the Services or use of any other Oz Properties services, and remove and discard any Content within the Services, for any reason, including, without limitation, for lack of use or if Oz Properties believes that you have violated or acted inconsistently with the letter or spirit of the TOU. Oz Properties may also in its sole discretion and at any time discontinue providing the Services, or any part thereof, with or without notice.

Any termination of your access to the Services under any provision of this TOU may be effected without prior notice, and acknowledge and agree that Oz Properties may immediately deactivate or delete your online real estate office and all related information and files in your online leasing office and/or bar any further access to such files or the Services. Further, Oz Properties shall not be liable to you or any third-party for any termination of your access to the Services.

GST

Unless stated to be otherwise, charges referred to for use of any services provided by Oz Properties are GST inclusive. Where GST applies, upon payment for online credit by a Oz Properties member, Oz Properties will deduct the GST it incurs from each payment and Oz Properties will issue the member with a Tax Invoice. The balance of the payment will be credited to a member's account. GST means the Australian goods and services tax charged under A New Tax System (Goods and Services Tax) Act 1999 (the "Act"). Tax invoice means tax invoice as defined by the Act.

Third party links and advertising

We provide links to Web sites outside of our web sites, as well as to third party Web sites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of companies linked to our website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of using that Web site and its privacy statement.

Applicable law

These conditions and all other specific and additional terms which govern your use or membership of and access to Oz Properties will be governed by and construed in accordance with the laws of the state of Queensland, Australia.
